Agriculture (Control of Importation) ACT
Overview
The Agriculture (Control of Importation) Act is a Nigerian law enacted on March 31, 1964, to regulate the importation of agricultural goods to control plant diseases and pests. It empowers the Minister responsible for agricultural research to designate authorized officers and make regulations prohibiting, restricting, or conditioning the importation of plants, seeds, soil, containers, packing materials, fertilizers, and similar items. Regulations may specify import locations, detention and examination procedures, fees, and penalties for violations (max fine N200 or 6 months imprisonment). All regulations must be laid before the National Assembly, which may approve, amend, or revoke them. Authorized officers may order destruction or treatment of infected imports. They can also require information for investigations, with disclosure restricted. The Act includes provisions on offences, prosecution, defense in proceedings, and recovery of fees. It defines key terms such as 'plant,' 'pest,' and 'plant disease.'
