Business Facilitation (Miscellaneous Provisions) Act, 2022
Overview
The Business Facilitation (Miscellaneous Provisions) Act, 2022 is a Nigerian federal law enacted to improve the ease of doing business, ensure transparency, efficiency, and productivity. It applies throughout the Federal Republic of Nigeria. The Act mandates Ministries, Departments, and Agencies (MDAs) to publish complete lists of requirements for permits, licenses, waivers, tax processes, filings, approvals, registration, certification, and other products and services. These lists must include all processes, documents, fees, and timelines, and be published on the MDA's website and at customer help desks within 21 days of commencement. MDAs must maintain an up-to-date register of applications. If an MDA fails to communicate a decision within the stipulated timeline, applications are deemed approved. MDAs must have at least two communication modes for official decisions. Rejections must include reasons. The Act promotes a 'one government' directive, service level agreements, port operations reforms, and streamlined business registration. It makes consequential amendments to various existing laws to institutionalize these reforms. The Act commenced on 8 February 2023.
