Overview

The Energy Commission of Nigeria Act, Chapter E10 of the Laws of the Federation of Nigeria, establishes the Energy Commission of Nigeria as a statutory body with the primary mandate of coordinating and overseeing the systematic development of Nigeria's energy resources. The Act was enacted in 1979 (No. 62) and commenced on 14th September 1979, with subsequent amendments in 1983 (No. 1) and 1989 (No. 19). The Commission is structured into several departments: Energy Information System (including Library and Computer Services); Energy Planning and Analysis (covering Energy Efficiency Demand Management and Conservation, Rural Energy, Alternative and New and Renewable Energy Sources); Training and Manpower Development; Administration and Finance; and other departments as approved by the Commission on the recommendation of the Director-General. The Commission's membership is composed of the President as chairman, or a designated alternate, and includes the Ministers responsible for power and steel, petroleum resources, science and technology, defence, agriculture and rural development, water resources, external affairs, and finance. The Director-General of the Commission serves as Secretary. A Technical Advisory Committee is established as the technical arm, chaired by the Director-General, and includes professionals representing various ministries (petroleum resources, power and steel, science and technology, agriculture and rural development, water resources, finance, defence, industries, education, communication, environment), agencies (Nigerian Mining Corporation, Nigerian Coal Corporation, National Electric Power Authority, Nigerian National Petroleum Corporation), and professional organizations (Solar Energy Society of Nigeria, Nigerian Mining and Geosciences Society, Nigerian Society of Engineers). The Committee may co-opt other Nigerians as needed. The Commission has the power to regulate its own proceedings, make standing orders, and function despite vacancies or absences. It must meet at least twice a year. The functions of the Commission include overall supervision of energy resource development, advising the government on energy policy, preparing periodic energy plans, promoting research and development in energy, collecting and disseminating energy data, training personnel, and liaising with international bodies. The Commission acts under the direction of the President or relevant Minister. The Director-General is the chief executive, appointed by the President, and other staff are appointed by the Commission. Funds of the Commission come from government allocations, grants, and other sources. The Act also provides for interpretation and the short title.
