Overview

This document is an Executive Order issued by the Government of Nigeria on May 18, 2017, entitled 'On the Promotion of Transparency and Efficiency in the Business Environment.' The order aims to create an enabling business environment by promoting transparency and efficiency in government agencies. Key provisions include: (1) All Ministries, Departments, and Agencies (MDAs) must publish complete lists of requirements, fees, and timelines for obtaining permits, licenses, waivers, and approvals within 21 days, and keep them updated. (2) If an MDA fails to communicate approval or rejection within the stipulated time, applications are deemed approved (default approval). Rejections must include reasons and be tracked. (3) At least two modes of communication (e.g., letters, emails, website posts) must be used for decisions. (4) Applicants whose applications are deemed granted can request official documentation within 14 days. (5) Failure of officials to act on time without lawful excuse constitutes misconduct. (6) MDAs requiring documents from other MDAs must only request photocopies or prima facie proof from applicants, with the originating MDA responsible for verification. The order is signed by the Acting President and establishes the Presidential Enabling Business Environment Council to coordinate implementation.
