Overview

The Federal Airports Authority of Nigeria Act (CAP. F5, Laws of the Federation of Nigeria 2004) establishes the Federal Airports Authority of Nigeria (FAAN) as a corporate body with perpetual succession. The Act is divided into six parts. Part I establishes the Authority and its Governing Board. The Board includes a part-time chairman appointed by the President on the Minister's recommendation, representatives from the Ministry of Defense, Federal Ministry of Aviation, Nigerian Airways Limited, Nigerian College of Aviation Technology, Federal Ministry of Finance, Federal Ministry of Justice, the Managing Director, and three other persons with aviation experience appointed by the President. Members serve four-year terms, renewable once, except ex-officio members. Part II outlines the Authority's functions: to manage and maintain airports transferred from the Ministry under the Civil Aviation Act and any additional airports provided by the Minister. The Authority has general powers including entering contracts, acquiring property, and charging fees. It may discontinue airport use with Ministerial approval, manage additional airports, and must follow Ministerial directions. Part III covers staff: a Managing Director appointed by the President, other staff appointed by the Authority, and pension provisions. Part IV addresses finances: revenue from fees and charges, duty to be financially prudent, borrowing powers with Ministerial consent, investment of funds, and annual accounts audited by the Auditor-General. Part V grants compulsory land acquisition powers, entry for surveys, compensation for damages, and limits on lawsuits against the Authority (six-month notice requirement, one-year limitation). Part VI includes miscellaneous provisions: power to make bye-laws, annual reports to the Minister, exemption from taxes and tenement rates, offences by bodies corporate, venue for trials (High Court of a State or Federal High Court), dissolution of the Federal Civil Aviation Authority and Nigerian Airports Authority, and interpretation. The Act repeals the Federal Airports Authority of Nigeria Act 1986 and the Nigerian Airports Authority Act 1986, transferring their assets and liabilities to FAAN.
