Overview
The Mini-Grid Regulations, 2023, issued by the Nigerian Electricity Regulatory Commission (NERC), provide a comprehensive legal and regulatory framework for the development, operation, and management of mini-grids in Nigeria. The regulations are made under the powers conferred by section 226 of the Electricity Act 2023. They cover various aspects including registration, permitting, operation, commercial arrangements, and dispute resolution for both isolated and interconnected mini-grids. Key provisions include the classification of mini-grids based on capacity (up to 100 kW and above 100 kW up to 1 MW), mandatory conditions for permits, tariff determination methodologies (including the MYTO tool), exclusivity periods for project development, quality of service standards, safety and environmental protections, customer connection procedures, and guidelines for interconnection with the main distribution network. The regulations also include schedules with forms, guidelines, contract templates, and calculation tools to facilitate compliance and standardization. The effective date is upon approval by a resolution of the Commission.
