Overview

The National Agency for the Control of HIV and AIDS (Establishment) Act, 2007 is a Nigerian law that establishes the National Agency for the Control of HIV and AIDS (NACA) as a corporate body with perpetual succession and a common seal. The agency is headquartered in Abuja and may establish branch offices and research centers within and outside Nigeria. It is supervised by the Presidency. The Act creates a Governing Board consisting of a chairman and six members including a legal practitioner, a public health expert, a medical scientist, a journalist, a social scientist, and an accountant. The Board is responsible for the general control and administration of the Agency. The Agency's functions include coordinating the national response to HIV/AIDS, developing policies, guidelines, and standards, conducting research, monitoring and evaluation, mobilizing resources, and collaborating with national and international bodies. The Agency has powers to enter contracts, acquire property, and engage in activities necessary for its functions. The Act also establishes the National Council on HIV and AIDS Afflictions, which advises the President on policies and coordinates multi-sectoral responses. The Agency's staff are appointed by the Board, and their terms and conditions are determined by the Board. Financial provisions include funding from the federal government, grants, and donations, subject to approval. The Agency is exempt from certain taxes. The Act includes transitional provisions for the transfer of assets, liabilities, and staff from the previous HIV/AIDS coordination body. The Act is severable, meaning invalidity of any part does not affect the rest. It came into effect on February 22, 2007.
