Overview
The National Biotechnology Development Agency (Establishment) Act, 2022 is a Nigerian federal law enacted on April 6, 2022, to establish the National Biotechnology Development Agency (NBDA) as a corporate body with perpetual succession. The Act outlines the agency's purpose to carry out research, create and develop public awareness in biotechnology, and encourage private sector participation in Nigeria's biotechnology industry. It is structured into seven parts: Part I establishes the Agency and its Governing Board, detailing board membership, tenure, remuneration, and powers. Part VI deals with legal proceedings, requiring notice to the Agency before suits. Part VII includes miscellaneous provisions: property powers, indemnity for directors, ministerial directives, powers to make regulations, and repeal of the National Biotechnology Development Agency Act (No. 24 of 2014). The Act contains 36 sections and a schedule replacing previous legislation.
