Overview

The National Film and Video Censors Board Act establishes the National Film and Video Censors Board to regulate the censorship and public exhibition of films and video works in Nigeria. The Act is structured into nine parts, covering the establishment, functions, membership, and staff of the Board; financial provisions; proceedings; registration of premises; licensing of distributors and exhibitors; censorship of films; video work regulation; and miscellaneous provisions. The Board is a corporate body with perpetual succession, tasked with licensing premises for film and video exhibition, licensing distributors and exhibitors, registering films and video works, issuing censorship certificates, and enforcing compliance. The Act provides for the appointment of an Executive Director, a secretary, and other staff, and outlines the Board's borrowing power, annual estimates, and accounts. Legal provisions include limitations on suits against the Board, service of documents, and indemnity for members and employees. The Act establishes Zonal Film Censors Committees and Zonal Video Censors Committees to handle classification and appeals. It details offences related to unlicensed exhibition, unclassified works, false classification, and penalties including forfeiture. The Act also addresses the protection of underage persons and restricts certain exhibitions. The effective date is August 25, 1993, based on Act No. 85 of 1993.
