Overview

The National Senior Secondary Education Commission Act, 2023, is a Nigerian federal law enacted on 11th May 2023 and published in the Official Gazette on 25th July 2023. The Act repeals the National Secondary Education Commission etc. Act (Cap. N73, Laws of the Federation of Nigeria, 2004) and establishes the National Senior Secondary Education Commission (NSSEC) with the objective of prescribing and enforcing minimum standards for senior secondary education in Nigeria, as well as managing the National Senior Secondary Education Commission Fund. The Act is arranged into eight parts covering: objectives and application; establishment of the Commission and its Governing Board; functions and powers of the Commission; appointment of the Executive Secretary and staff; financial provisions; objectives, establishment, and disbursement of the NSSEC Fund; establishment, composition, and functions of state senior secondary education boards; and miscellaneous provisions. Key elements include the creation of the Commission as a body corporate with perpetual succession, a Governing Board with specified tenure and powers, and the Executive Secretary as the chief executive. The Act provides for Federal Government intervention or grants to enhance infrastructure in Federal Unity Colleges, the 36 states, and the Federal Capital Territory (FCT) to address infrastructural gaps. It also mandates the establishment of State Senior Secondary Education Boards to oversee senior secondary education at the state level.
