Nigeria Export Processing Zones Authority - NEPZA, Act
Overview
The Nigeria Export Processing Zones Act (CAP N107) establishes a legal framework for the creation and operation of Export Processing Zones (EPZs) in Nigeria. The Act, enacted on November 19, 1992, empowers the President to designate areas as EPZs upon recommendation of the Nigeria Export Processing Zones Authority (NEPZA). NEPZA is a corporate body established to oversee the zones, with a governing Board comprising representatives from federal ministries (Commerce, Culture and Tourism, Industry, Science and Technology), the Comptroller-General of Customs, and the Managing Director of the Nigerian Ports Authority. The Authority's functions include promoting investment, approving enterprises for approved activities (listed in the Third Schedule, e.g., manufacturing, warehousing, processing), granting licenses, issuing work permits, and managing zone affairs. Key provisions include: exemption from taxes (customs duties, levies) on imported goods for approved enterprises; prohibition of retail trade within zones; special rules for goods imported with duty cessions; prohibition of ammunition storage; and requirements for enterprises to submit returns. The Act also covers the vesting of property in the Authority, payment for goods/services, import and export regulations, incentives, staff regulations, and the Authority's fund. Enactments applicable in customs territory apply, with non-compliance penalties. Repeals and regulations are outlined, along with definitions and short title.
