Overview

The Nigerian Atomic Energy Commission Act, 1976 (No. 46), establishes the Nigerian Atomic Energy Commission (NAEC) as a body corporate with perpetual succession and a common seal. The Commission is responsible for promoting the development and peaceful use of atomic energy, including prospecting and mining radioactive minerals, constructing and maintaining nuclear installations for electricity generation, producing and disposing of atomic energy, conducting research, making grants, educating personnel, and advising the Federal Government. It has the capacity to enter contracts and manage property. The President can initiate or approve policy and issue directions to the Commission, which must implement them. Policies initiated by the Commission require presidential approval. The Act includes provisions for composition (a chairman and other members appointed by the President), staff, financial provisions (including a fund and accounts, with audits), annual reports to the President, compulsory acquisition of land, restrictions on disclosure of information relating to nuclear installations, duty to prevent nuclear damage, regulations, interpretation, and a short title. The Schedule provides supplementary provisions on Commission proceedings. The Act came into force on August 24, 1976, and references the Minerals and Mining Act for compliance.
