Overview

The Nigerian Correctional Service Act, 2019 (the Act) is a comprehensive legislation that repeals the Prisons Act Cap. P29, Laws of the Federation of Nigeria, 2004, and establishes the Nigerian Correctional Service. The Act provides a legal framework for the administration of custodial and non-custodial services in Nigeria, with a focus on reformation, rehabilitation, and reintegration of offenders, as well as compliance with international human rights standards. It creates two main branches: the Custodial Service, responsible for the custody, care, and correction of inmates in custodial centers, and the Non-Custodial Service, which oversees alternative measures such as parole, probation, community service, and restorative justice. The Act outlines the structure of the Correctional Service, including the appointment and powers of the Controller-General and Deputy Controllers-General. Key provisions cover the classification and functions of custodial centers, documentation and treatment of inmates, healthcare and mental health services, inmate labor, transfer and production of inmates before courts, use of firearms, visitors and inspections, staff training, security measures, and rules regarding escapes and inmate deaths. Specific attention is given to female inmates and juvenile offenders. The Non-Custodial Service is established under Part II, with a National Committee on Non-Custodial Measures to develop regulations and guidelines. The Act also provides for a Correctional Officers Reward Fund, pension benefits, legal actions against the Service, and the repeal of the former Prisons Act. The explanatory memorandum emphasizes that the Act addresses new issues not covered by the repealed Act and sets clear obligations for the Service and rights of inmates.
