The Nigerian Export Promotion Council Act of 1987 establishes the Nigerian Export Promotion Council (the Council) as a body corporate with perpetual succession. The Council is governed by a Board comprising a chairman appointed by the President on the recommendation of the Minister, representatives from Federal Ministries (Foreign Affairs, Commerce, Culture and Tourism), the Nigerian Customs Service, associations (Nigerian Association of Chambers of Commerce, Industries, Mines and Agriculture; Manufacturers' Association of Nigeria; Association of Nigerian Exporters; Farmers' Association), one private sector appointee with relevant experience, and the executive director. Members serve a four-year term, renewable for a further two years. The Council's functions include promoting Nigeria's export trade diversification, assisting export-oriented industries, spearheading export incentives, coordinating export policies and programs, and arranging buyer-seller meetings, trade missions, and publicity campaigns. The Act also provides for staff regulations, an export committee, funding from the Federal Government and other sources, annual estimates and audits, annual reports to the Minister, and the power to make regulations. It repeals the Nigerian Export Promotion Council Act 1976 and transfers assets and liabilities to the new Council.
