Overview

The Pest Control of Produce (Special Powers) Act, enacted on 29th May 1968 in Nigeria, grants special powers to pest control inspectors of produce to inspect and fumigate produce at ports to control pests before export. The Act authorizes inspectors appointed by the Minister of Commerce to enter buildings, vehicles, and ships within port areas to inspect produce and fumigate if needed. Inspectors can condemn produce if no other control is suitable, invoking provisions of the Produce (Enforcement of Export Standards) Act. Offences include failure to comply with inspector requirements or hindering inspectors, with penalties of fines (N200–N1,000 for first offence) or imprisonment (12 months to 5 years for subsequent convictions). The Minister may make regulations, prescribe fees, and declare port areas. The Act applies to all Nigerian ports, international airports, and territorial waters.
