The Raw Materials Research and Development Council Act, 2022 is a Nigerian federal law enacted on 25th August 2022, repealing the previous Cap. R3 LFN, 2004 version. It establishes the Raw Materials Research and Development Council as a corporate body with perpetual succession, empowering it to sue and be sued, and to acquire, hold, or dispose of property. The Council's primary objectives are to develop local raw materials and coordinate research efforts in acquisition, exploitation, conservation, and development. Its functions include ensuring systematic exploitation and utilization of Nigeria's raw material resources, drawing up policy guidelines, reviewing resource availability and utilization to advise the Federal Government on strategic implications, advising on machinery and processes, encouraging dissemination of research findings, promoting in-plant R&D, devising awards for industrial breakthroughs, and organizing workshops, symposia, and seminars. The Act also provides for a Board of the Council, with specific functions, tenure, remuneration, and cessation of membership. The Director-General is appointed by the President on the recommendation of the Minister, and other staff are appointed by the Council. The Council's funds come from government allocations, internally generated revenue, and gifts. It must prepare annual estimates, accounts subject to audit, and submit annual reports. The Council can borrow with Ministerial approval, accept gifts, and is indemnified for actions in good faith. Legal proceedings are to be conducted in the name of the Council, and execution against its property is restricted. The Act includes a schedule for transitional provisions.
