Overview

This document is an official circular from the Federal Ministry of Finance, Budget and National Planning in Nigeria, dated 9 September 2029. It provides procurement guidelines for Ministries, Departments, and Agencies (MDAs) following President's assent to the 2022 Appropriation (Repeal and Enactment) Act. The circular addresses changes made by the National Assembly affecting procurement processes, particularly where projects or programmes were moved between agencies or their appropriated amounts changed. MDAs are instructed to adhere to advice from the Bureau of Public Procurement (BPP) regarding affected projects: (i) for projects with concluded procurement by initial agencies, new agencies should award contracts to recommended contractors; (ii) for unconcluded procurement, new agencies should conclude and award; (iii) for uncommenced projects, new agencies should start procurement using open competitive bidding per the Public Procurement Act 2007 and SGF circular; (iv) where budgets were reduced, agencies should re-scope and procure within reduced funding for single-year projects, while multi-year construction projects may not need re-scoping but should have shortfalls accommodated in subsequent budgets. The circular is signed by the Honourable Minister of Finance, Budget and National Planning and is directed to high-level officials including the Chief of Staff to the President, ministers, the Head of Civil Service, and heads of parastatals and agencies.
